We at EcoEquity Platform (referred to here as “EcoEquity,” “Company,” “Our,” “US,” or “We”) respect and protect the privacy of those who explore our Services (“Users”) and Users who sign up for and access our Services (“Customers”).

This Privacy Policy describes how we collect, use, and share personal information when you explore, sign up for or access our “Services”, which include the services offered on our website . (“Site”) or when you use the EcoEquity mobile app (“App”).

If you reside outside of the UK and the European Economic Area (the “EEA”), accessing the Site and using our Services means that you accept this Privacy Policy and its terms.

  • EcoEquity’s goal is to revolutionize carbon offset credit trading which includes providing our Users with an easy to use, best in class trading platform. Operating the platform requires Users to provide personal information. If you do not want us to collect, use, or disclose your personal information, as described in this Privacy Policy, or you are under 18 years of age, you should stop accessing our Services.
  • EcoEquity collects and uses your information in order to provide and improve our Services and your experience, protect the security and integrity of our platform, and meet our legal obligations. Section 1 of this Privacy Policy describes the information we collect, and Section 2 describes how information collected is used.
  • Your information is shared with trusted third parties and service providers in order to offer our Services and fulfill legal requirements. Section 3 describes how and why EcoEquity shares your information.
  • We offer privacy tools on your profile or account settings page for you to request access to or deletion of your information we have retained. Depending on where you live, you may also have other privacy rights under law. You must remember that certain information we retain is essential for you to use the platform or to meet legal requirements.

1. INFORMATION WE COLLECT

Depending on your interaction with the platform, we collect personal information and documentation from the categories listed below. We do not require information to simply visit the website. Minimal information is requested if you ask EcoEquity to contact you. More extensive information, including information to meet legal requirements, is required to create and use an EcoEquity account.

Information You Provide to Us:

  • Basic Customer Information: Name, Address, Date of birth, Nationality, Country of residence, Gender, Phone number, Email Address.
  • Supplemental Identification Information: Utility bills (for your billing address), Photographs and/or videos, Government-issued identity document, e.g. passport, driver’s license, or state identification card, Social security number, Employment information (e.g. company name), Proof of residency, including visa information.
  • Electronic Identification ("EIDV") Information: Depending on the identity verification method, biometric information generated based on photos or videos you provide in order for us to verify your identity may be collected.
  • Institutional Information (if you are an institutional Customer): Employer Identification number (or comparable number issued by a government), Personal identification information for all material beneficial owners of your business.
  • Financial Information: Bank account number, Payment card primary account number ("PAN"), Trading and investment experience, Tax identification number, and Income/net assets/wealth verification statements.
  • Wallet Information: When you create your account, we collect your Wallet address and information related to integrations that you select.
  • Preferences: We collect information concerning your payment preferences.
  • Transaction Information: Information about the transactions made on our Services, such as the name of the sender, the name of the recipient, the amount, currency preferences, payment method, date, and/or timestamp.
  • Additional information you submit to us: Survey responses and information (including call recordings) provided to our Customer Support team or User Research team.

Information Collected Automatically

  • App, browser, and device information: Information about the device, operating system, and browser you’re using. Other device characteristics or identifiers (e.g. plugins, the network you connect to). IP address.
  • Product Usage Information (Activity): Information about what you view or click on while visiting our Sites and Apps and how you use our Services.
  • Product Usage Information (Diagnostic and Troubleshooting Information): Information about how our Services are performing when you use them, i.e. service-related diagnostic and performance information, including timestamps, crash data, website performance logs, and error messages or reports.

Information we obtain from Affiliates and third parties

  • Public Database Information: We obtain information about you from public databases, such as the United Nations Sanctions List, US ITA Consolidated Screening List, and the SEC EDGAR, including your name, address, email address, phone number, gender, national ID number and nationality/country of residence, date of birth, job role, public employment profile, listing on any sanctions lists maintained by public authorities, and other data as necessary.
  • Blockchain Data: We may analyze public blockchain data, including timestamps of transactions or events, transaction IDs, digital signatures, transaction amounts, and wallet addresses.
  • Information from our Marketing and Advertising Partners: We receive information such as your name and contact information from our marketing partners, including in some instances what marketing content you viewed or the actions you take on our Site.
  • Information from Analytics Providers: We receive information about your Site usage, interactions, age group, and survey responses (including prior to account creation, in some cases).
  • Research and In-App Survey Information: We use third party service providers to conduct in-app surveys to better understand our Customers’ experience and improve our Services. The information we receive from our research partners is pseudonymous.

2. HOW WE USE YOUR INFORMATION

We use your personal information to deliver, personalize, operate, improve, create, and develop our Services, to provide you with a secure, smooth, efficient, and customized experience as you use them, and for legal compliance, loss prevention, and anti-fraud purposes. The following sections explain in greater detail how your personal information is used and the legal basis for such data use.

Data Required to Perform Our Contract With You

We use certain information that is necessary to conclude and perform our Terms of Use and any other contract with you. Your account will be terminated if we cannot process personal information required to create or maintain your account. Below are descriptions of these activities and the types of information used in each activity.

  • To create and maintain your EcoEquity account

  • To provide you with Consumer Services

    Provide you with personalized Services offered on the platform and provide you access to your digital wallets including hosting and maintaining your digital wallets.   • To provide you with Institutional Services

    Provide Services to you, investors, and institutions to allow listing of carbon offset projects and the purchase and sale of these credits. Information categories: Basic Customer Information, Supplemental Identification Information, Financial Information, Institutional Information, Additional information you submit to us, Wallet Information, and Transaction Information.
  • To provide customer support

    To address your request for support in the Apps, via the Sites, or by email and to respond to customer care and other inquiries, including providing telephone-based premium customer support to Customers who provide their telephone numbers, chat message support, and social support. Information categories: Basic Customer Information, Supplemental Identification Information, Transaction Information, Product Usage Information (including Location Information), and Communications.
  • To send Service communications

    To send you administrative or account-related communications about our Services, which can include security updates or transaction-related information, through email, telephone, or in-product/push notifications. You may not opt-out of receiving critical service communications, such as emails or mobile notifications sent for legal or security purposes.   • To promote the safety, security and integrity of our Services

    To verify accounts and related activity, find and address violations of our Terms of Use or policies, investigate suspicious activity, detect, prevent and combat harmful or unlawful behavior, detect fraudulent behavior, and to maintain the integrity of our Services, including account takeover (“ATO”) prevention and support. Data to Comply With Our Legal Obligations

Our Services are subject to laws and regulations that require us to collect, use, and store your personal information in certain ways. If you do not provide the personal information required by law, we will be unable to open an account for you or will have to close your account.

  • To verify your identity

    We are generally required to collect certain personal information to properly identify or verify your identity and comply with other specific anti-money laundering (“AML”) or sanctions laws and regulations.  Our verification processes also involve electronic identification through the comparison of your photo against your provided verification information, which may be deemed biometric information.  All such information is securely maintained by EcoEquity and its service providers, and is only disclosed where permitted or required by law.   • To determine your legal eligibility for certain regulated products

    When you use certain locally regulated products or engage in certain advanced trading activities, we may be required to carry out additional checks to ensure your suitability in accordance with regulations such as the European Market Infrastructure Regulation. Information categories: Basic Customer Information, Financial Information, and Supplemental Identification Information.
  • To comply with other legal and regulatory obligations

    We may access, read, preserve, and disclose information when we believe it is reasonably necessary to comply with applicable law and regulations, legal obligations, law enforcement, tax authorities, governmental, and other legal requests, or court orders.

    Examples of laws that may require us to collect, use or disclose your information:
    • Civil, commercial, criminal, or consumer protection matters: A court order to disclose information for the purposes of court proceedings or regulatory inquiries such as the Irish Competition and Consumer Protection Act 2014, US federal and state consumer protection and privacy laws, courts with jurisdiction over EcoEquity or its customers, and Singapore Criminal Procedure Code 2010.
    • Corporate and taxation matters: The U.S. Internal Revenue Service Code and tax laws of other jurisdictions applicable to EcoEquity.
    • Regulatory matters: Compliance with regulatory obligations and communications, both official and unofficial, with regulators such as (but not limited to) the U.S. Commodity Futures Trading Commission, the National Futures Association, the U.S. Securities and Exchange Commission, and the UK Financial Conduct Authority.

Data for Our Legitimate Interests

EcoEquity and in some instances third parties such as customers and the general public have legitimate interests that justify or require the use of personal data. In these situations, your data is only used if its use is not outweighed by your rights and freedoms. In the EEA and UK, you have the right to object to and restrict processing of this data.     In order to perform core metrics, customize your experience with our Services, and to generally improve our Services, we collect information about your online activity while you are using the Services such as frequency of activity, pages viewed, and services used.   • To provide you with promotions

    We may use your information to provide promotions, incentives, and rewards for using our Services. Legitimate interest: It is in our interest and your interest to reward customer loyalty.   • We preserve and share information to comply with requests from law enforcement, civil litigants, and other legal requests

    Under the following circumstances where there is a reasonable, good faith belief that EcoEquity may in the future be legally required to provide your data, we may preserve and upon receipt of a binding legal order share your information:
    • Requests from third parties, such as civil litigants, law enforcement, and other governmental authorities, to assist in investigations;
    • In EcoEquity’s defense in litigation or other disputes; and/or
    • In response to Customer requests or communications, during the review of Customer accounts and transactions in dispute or in litigation, and recording account details for litigation and settlement purposes.
    Legitimate interest: It is in our interest and the interest of the general public to prevent and address fraud, unauthorized use of the Services, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, EcoEquity personnel and property or the Service), our Customers or others, including situations where there is an investigation or regulatory inquiry; to defend EcoEquity’s legal rights and resolve disputes; to secure our platform and network; to verify accounts and activity; to combat harmful conduct; to detect, prevent and address fraud, abuse, spam and other negative experiences, or to prevent death or imminent bodily harm.   • To promote safety, security and integrity

    In addition to performing our contract with you, we may use and analyze your information to protect the integrity of our Services. For example:

    • Identify and investigate patterns of suspicious behavior or violations of our policies and Terms of Use.

    We may conduct surveys of your experience with EcoEquity and your activity to conduct and support research and innovation on topics related to our Services.     To provide communications and customer support through our Customer Support team and User Research team. Legitimate interest: It is in our interest and our Customers’ interest to provide customer support and improve our Services. Information categories:

Data We Use Based on Your Consent

EcoEquity must have your consent to use some or your data. You may withdraw this consent at any time, although it will not apply to our use of your data prior to withdrawal of consent. You may withdraw or change your consent preferences on your device or app settings anytime as described in Section 7, Your Privacy Rights and Choices. Purposes for the use of data where user consent is required are described below.

  • To enable device-based settings

    Collecting information that you allow us to receive through the device-based settings you enable such as access to your GPS location, camera, or photos, which we use to provide the features or services described when you enable the setting.   • To provide marketing communications to you

    To send you targeted marketing communications through email, mobile, in-app, push notifications, and by SMS. You may also see ads for our Services when you visit other apps and websites. Data Protect Vital Interests of Our Users and Others

  • Preserving, reviewing, and sharing information with law enforcement and others

    We may preserve, review, and share information with law enforcement and others in circumstances where someone’s vital interests require protection. For example, where there is a risk to the safety and security of an EcoEquity Customer.     The legal basis for the use of this data may vary depending the governing jurisdiction.

3. HOW AND WHY WE SHARE YOUR INFORMATION

We work with service providers, partners and other third parties to help us provide our Services, and as a result we need to share certain information with these third parties. This section describes how and why this data is shared.

Data Shared With Affiliates

Personal information that we process and collect may be transferred between companies that are owned or controlled by EcoEquity and affiliated employees during the course of conducting business and offering our Services to you. Companies owned or controlled by EcoEquity are shown on the website .

Professional advisors, industry partners, authorities and regulators

When required, we share your information described in Section1, Information We Collect, with our advisors, regulators, tax authorities, law enforcement, government agencies, and industry partners to:

  • Respond pursuant to applicable law or regulations, court orders, legal process or government requests;
  • Comply with our reporting and information sharing obligations with industry partners, including other Virtual Asset Service Providers (“VASPs”) and regulatory authorities;
  • Detect, investigate, prevent, or address fraud and other illegal activity or security and technical issues; and
  • Protect the rights, property, and safety of our Customers, EcoEquity, and other stakeholders.

Asset Transfer or Company Acquisition

EcoEquity may enter transactions for the purchase or sale of assets which require the transfer of customer information; however, any information transferred will be solely for business purposes and in accordance with applicable law including any consent requirements. Also, EcoEquity may be a party to a merger, acquisition, or other corporate reorganization which requires the transfer of your personal information to an acquiring party. Any transfer will be consistent with applicable law including consent requirements.

Third-Party Service Providers

We work with third-party service providers that help us provide our Services. Third-party providers who receive information from EcoEquity are required to use your information only for executing their obligations to EcoEquity in accordance with our instructions and terms.

4. HOW LONG WE RETAIN YOUR PERSONAL INFORMATION

Retention periods for your information are determined by business and legal requirements. In general, your information is retained for the length of time required based on your type of interaction with EcoEquity ranging from information inquiries through the life of an active account. Retention periods for certain information is subject to legal and regulatory requirements imposed in the jurisdictions where EcoEquity operates. That type of information is retained in accordance with applicable laws and regulations. Certain specific retention requirements such as those related to AML and other financial regulations are stated in the policies that govern those specific matters.

Your personal information is deleted when no longer required for business and legal compliance. Subject to legal restrictions, your information is deleted when you close your account or request deletion of non-essential information on your account settings page.

5. CHILDREN'S PERSONAL INFORMATION

Individuals under the age of 18 are not permitted to create accounts or engage in transactions on the EcoEquity platform. EcoEquity does not seek to collect or request information from individuals under 18, and those individuals should provide EcoEquity with their personal information under any circumstances. In the event that EcoEquity determines that it has received personal information for an individual under the age of 18, the information will be deleted, and any activity on the platform will be addressed in an appropriate and legal manner.

6. INTERNATIONAL TRANSFERS

EcoEquity engages in business around the world. To facilitate our global operations, EcoEquity and its third-party partners and service providers may transfer, store, and process your personal information in different countries. Data transfers are governed by laws and regulations enforced by different jurisdictions and modified by various international agreements. Based on the origin and destination of the data, EcoEquity implements procedures to identify and implement applicable data privacy laws that govern these transfers.

7. YOUR PRIVACY RIGHTS AND CHOICES

Depending on where you live, you may be able to exercise certain privacy rights related to your personal information. You may request information about your personal information and related privacy through your account profile page on the website or by submitting a request to operations@ecoequityplatform.com . If not available in your jurisdiction, EcoEquity may provide any of the privacy rights described below at its discretion.

    You may request that EcoEquity erase your personal information, subject to applicable law. If you close your EcoEquity Account, your personal information will be retained in accordance with the Company’s record retention policy.
  • Right to withdraw your consent:

    You may withdraw your consent allowing EcoEquity to process your personal information at any time; however, your withdrawal will not apply to processing performed prior to the withdrawal request.
  • Right to object to or restrict processing:

    You may have the right to restrict or object to us using or transferring your personal information based on our legitimate interests, in the public interest, or for direct marketing. We may continue to process your personal information where permitted or required by applicable law. You can opt-out of receiving marketing communications from EcoEquity through your account settings or submitting a request to operations@ecoequityplatform.com.
  • Right to non-discrimination:

    We will not discriminate against you for exercising any of your rights provided to you under law.

To protect your privacy and security, we may verify your identity before complying with your request, and we may decline your request if we are unable to verify your identity.

Under certain US data privacy laws, as well as in Brazil, you may also designate an authorized agent to make these requests on your behalf.

These rights are not absolute and their exercise is subject to applicable law.

If you reside in the EEA or Switzerland, EcoEquity is a controller of your personal information. As a controller, EcoEquity will provide you with information and responding to any requests you may make under the GDPR.
